AUSTIN — A federal judge in Austin has denied a request for a temporary restraining order on the construction of the Kinder Morgan Permian Highway Pipeline through parts of the Hill Country.

The order came from U.S District Court Judge Robert Pitman of the Western District of Texas, Austin Division on Friday.

“Kinder Morgan intends to begin construction immediately, first by clearing the land,” according to the order.

The Cities of Kyle, Austin, San Marcos, Travis County, Hays County, the Barton Springs Edwards Aquifer Conservation District and several landowners are suing Kinder Morgan, alleging they are violating the endangered species act.

Kinder Morgan said last month that the company had secured 100 percent of the right of way for the project.

Attorneys for the plaintiffs are expected to release a statement on Monday.
